THE MARYLAND HEALTH CONNECTION PRIVACY STATEMENT
This notice is designed to inform you how the information you provide when applying for health insurance through Maryland Health Connection will be used and of your rights to view, verify, or correct your personally identifiable information, as required under 45 C.F.R. § 155.260. We are authorized to collect the information on this form and any supporting documentation, including Social Security numbers, under the Patient Protection and Affordable Care Act (Public Law No. 111-148), as amended by the Health Care and Education Reconciliation Act of 2010 (Public Law No. 111-152), and the Social Security Act.
PERMISSION FOR INFORMATION SUBMITTED
By submitting this application, you represent that you have permission from all of the people whose information is on the application to both submit their information to Maryland Health Connection and to receive any communications about their eligibility and enrollment.
USE OF INFORMATION YOU PROVIDE
Should you decide to apply for health coverage through Maryland Health Connection, you will be voluntarily providing information to the system about yourself and/or your household members. On each screen, the system will notify you of all required information. Please respond to all questions honestly and carefully. If you don’t provide correct information on this form or knowingly or willfully provide false or fraudulent information, you may be subject to a penalty and other law enforcement action.
Information Collected Automatically
• Log Files
When you use this website, our servers automatically record information that your browser sends as you fill out your application. These server logs may include information such as your Internet Protocol (IP) address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser. This information is periodically deleted as part of normal maintenance routines.
• Digital Fingerprinting
We use digital fingerprinting technology, also known as "machine identification" technology, to gather certain data about you and/or your computer. This identification number is based on data that is automatically transmitted by your browser, such as your IP address and computer operating system and browser version number. This technology creates a unique computer identifier which may be used by the Maryland Health Connection to identify your device, which will allow us to improve the user experience, better safeguard your personal information, and to protect the integrity of the enrollment process.
The information you provide will be retained in our system. It will be verified against information from other federal and state systems and used to determine eligibility for insurance affordability programs, tax credits for health insurance, enrollment into a qualified health plan and may be used for bill payment, automated reminders, or other activities permitted by law. In order to perform these functions, we will need to share selected information that we receive outside of Maryland Health Connection, including with:
• Federal agencies (such as the Internal Revenue Service, Social Security Administration and Department of Homeland Security), other State agencies (such as the Department of Health and Mental Hygiene and Department of Human Resources) or local government agencies. We may use the information you provide in computer matching programs with any of these groups to make eligibility determinations, to verify continued eligibility for enrollment in a qualified health plan or federal benefit programs, or to process appeals of eligibility determinations;
• Other identity verification sources including consumer reporting agencies;
• Employers identified on applications for eligibility determinations;
• Applicants, enrollees and their authorized representatives;
• Authorized agents, brokers and issuers of qualified health plans, as applicable; and
• Authorized contractors engaged to perform a function for Maryland Health Connection.
We will preserve the privacy of personal records and protect confidential or privileged information in full accordance with federal and State law. We will not sell your information to others. Any information you provide to us will be used only to carry out functions of the Maryland Health Connection or as required by law.
VERIFICATION OF INFORMATION
As part of the process to sign up for health insurance, in order to confirm your identity and protect your privacy, you will need to complete Identity Verification successfully. Below are a few items to keep in mind.
• Ensure that you enter your legal name, current home address, primary phone number, date of birth and email address correctly. We will only collect personal information to verify your identity with Experian, an external identity verification provider.
• Identity Verification involves Experian using information from your consumer report profile to help confirm your identity. As a result, you may see an entry called a “soft inquiry” on your Experian consumer report. Soft inquiries are only visible to you, will never be presented to third parties, and do not affect your credit score. The soft inquiry likely will be titled “CMS Proofing Services” and will be removed from your Experian consumer report after 25 months.
• You may need to have access to your personal and consumer report information, as the Experian application will pose questions to you, based on data in Experian’s files. For additional information, please see the Experian Consumer Assistance website -
Maryland Health Connection offers all legal Maryland residents the ability to purchase affordable health insurance. We gather and verify information on the citizenship and/or immigration status of applicants. However, we use this information only to determine eligibility for health coverage.
PERSONALLY IDENTIFIABLE INFORMATION
This system will store Personally Identifiable Information (PII) that you provide. PII means any information that can be used to distinguish or trace an individual's identity, such as their name, Social Security Number, biometric records, etc., alone or when combined with other personal or identifying information that is linked or linkable to a specific individual, such as date and place of birth, mother's maiden name, etc. and any other information that is linked or linkable to an individual, such as medical, educational, financial or employment information. ENCRYPTION OF INFORMATION
Encryption is a process of scrambling information in order to protect its confidentiality. The entire process of signing up for health insurance uses encryption. Your data files stored in the system are encrypted. When our system transmits or receives your information in order to provide you service, your information is encrypted.
IMPROPER USE AND DISCLOSURE OF INFORMATION
Any person who knowingly and willfully uses or discloses information in violation of section 1411(g) of the Affordable Care Act will be subject to a civil penalty of not more than $25,000 per person or entity, per use or disclosure, in addition to other penalties that may be prescribed by law.
